Terms of Service

These Terms of Service (“Terms”) govern your access to and use of exploreyourgarden.site (the “Site”), operated by Explore Your Garden, an editorial publication founded by Giovanni Picaro. By accessing the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Definitions

  • “Site” — exploreyourgarden.site and all associated subdomains, pages, and content.
  • “Content” — all text, images, video, audio, code, and other material made available through the Site.
  • “User”, “you”, “your” — any person who accesses the Site.
  • “We”, “us”, “our” — the operators of Explore Your Garden.

2. Eligibility

The Site is intended for users aged 16 and over. By using the Site you represent that you are at least 16, or that you are using the Site under the supervision of a parent or guardian.

3. License to use the Site

We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. This license does not include:

  • Copying, redistributing, or republishing Content beyond limited fair-use quotation with attribution.
  • Using automated systems (scrapers, bots, harvesters) to extract Content, except for legitimate search engine indexing.
  • Using Content to train artificial intelligence or machine learning models without our express written consent.
  • Removing copyright, trademark, or other proprietary notices from Content.
  • Reverse engineering or otherwise attempting to derive the source code of any technical infrastructure used by the Site.

4. User-generated content

If you post comments, send us submissions, or otherwise contribute User Content:

  • You retain ownership of your contributions.
  • You grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, display, distribute, and adapt your contributions in connection with the Site and our promotional activities.
  • You represent that you have the right to grant this license and that your contributions do not infringe any third party’s rights.
  • We may, but are not obligated to, moderate User Content. We may remove any submission for any reason at our sole discretion.

5. Acceptable use

You agree not to use the Site to:

  • Violate any applicable law, regulation, or third-party right.
  • Post or transmit content that is unlawful, harassing, defamatory, obscene, or otherwise objectionable.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Distribute viruses, malware, or other harmful code.
  • Interfere with or disrupt the operation of the Site.
  • Engage in any activity that imposes an unreasonable load on the Site.
  • Solicit personal information from other users or use the Site to spam.

6. Intellectual property

All editorial Content on the Site — original articles, guides, reviews, plant profiles, glossary entries, photographs taken by us, original illustrations — is owned by Explore Your Garden and the respective authors and is protected by Italian copyright law (Legge 633/1941), the Berne Convention, and other applicable international copyright treaties.

Third-party Content used on the Site (publisher promotional images, brand logos in product reviews, brief quotations) is used under fair-use principles, fair-dealing exceptions, the Italian “diritto di critica e di cronaca” (Article 70 of Legge 633/1941), and similar provisions in other jurisdictions. The original copyright in such third-party Content remains with its respective owners.

7. Gardening advice and reader responsibility

The editorial Content on the Site is provided for general informational and educational purposes. Specifically:

  • Plant identification information should always be verified with local botanical references and, where consequences could be serious (foraging, medicinal use), with qualified local experts.
  • Toxicity and plant safety information is provided as a general reference, not as a substitute for veterinary, medical, or poison-control advice. See our Plant Safety & Hazards page.
  • Gardening techniques are described as we have practiced them in our test conditions; results in your conditions may vary.
  • Product reviews reflect our experience with the specific units we tested; manufacturing, batch variation, and post-purchase support may differ.

8. DMCA / Notice-and-takedown

If you believe Content on the Site infringes your copyright, please follow the procedure on our DMCA Page. We respond to all valid copyright notices in line with the United States Digital Millennium Copyright Act and corresponding European notice-and-takedown frameworks.

9. Disclaimers

The Site and its Content are provided “as is” and “as available” without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, or non-infringement. While we take care to ensure accuracy, we make no warranty that the Content is error-free, current, or complete.

10. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of the Site or any Content available through the Site.

Our total liability arising out of or related to these Terms or your use of the Site shall not exceed fifty euros (€50) or the equivalent.

Some jurisdictions do not allow exclusion or limitation of certain warranties or damages. In such jurisdictions, the above limitations may not apply, and our liability is limited to the smallest extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless Explore Your Garden, its founders, contributors, and operators from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any third-party right.

12. Third-party links and services

The Site contains links to third-party websites and services (manufacturer pages, seed suppliers, horticultural societies, affiliate retailers). We do not control these third parties and are not responsible for their content, privacy practices, or availability. Inclusion of a link does not constitute endorsement.

13. Advertising

The Site is partially supported by advertising, currently served through Google AdSense. The presence of an advertisement does not constitute endorsement. 14. Termination

We may terminate or suspend your access to the Site, without notice, for any reason, including breach of these Terms. The provisions of these Terms that by their nature should survive termination shall survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

15. Governing law and jurisdiction

These Terms are governed by the laws of the Italian Republic, without regard to its conflict-of-law provisions. Any dispute arising from or related to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Rome, Italy, except where mandatory consumer protection law assigns jurisdiction to the consumer’s place of residence within the European Union or equivalent law applies elsewhere.

16. Changes to these Terms

We may revise these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Site after a revision constitutes acceptance of the revised Terms.

17. Severability and entire agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Explore Your Garden with respect to the use of the Site.
